Terms and Conditions

1. Introduction

These Terms and Conditions govern all freight forwarding, customs clearing, cargo handling, transportation, warehousing, and logistics services provided by Affluent Services Cargo (“the Company”) to its clients (“the Customer”).

2. Acceptance of Terms

By engaging the Company’s services, the Customer agrees to be bound by these Terms and Conditions.

3. Customer Responsibilities

The Customer shall:

  • Provide accurate and complete shipment information.
  • Ensure all goods comply with Zimbabwean and international laws.
  • Submit all required documentation on time.
  • Pay all applicable charges, duties, taxes, and fees when due.
  • Properly package goods to prevent damage during transit.

4. Customs Clearance

  • Customs clearance is subject to approval by relevant authorities, including ZIMRA and other regulatory agencies.
  • The Company acts solely as an agent on behalf of the Customer.
  • The Customer remains responsible for the accuracy of all customs declarations and supporting documents.
  • Any penalties, fines, or delays arising from incorrect information provided by the Customer shall be the Customer’s responsibility.

5. Freight and Transportation

  • Delivery and transit times are estimates and are not guaranteed.
  • The Company shall not be liable for delays caused by customs inspections, border congestion, weather conditions, carrier schedules, strikes, or other events beyond its control.
  • Freight rates are subject to change without prior notice due to fuel surcharges, carrier adjustments, exchange rate fluctuations, or regulatory changes.
  • Any Air Cargo shipment – Fractions of a kilogram are rounded up to the next full kilogram
  • Any Sea Cargo – Where cargo is classified as heavy cargo, freight charges may be calculated on a weight-to-volume conversion basis of 800 kg = 1 CBM.

6. Prohibited and Restricted Goods

The Company reserves the right to refuse shipment of:

  • Illegal goods.
  • Dangerous or hazardous materials not properly declared.
  • Counterfeit products.
  • Weapons, ammunition, explosives, or prohibited substances.
  • Any goods restricted by local or international regulations.

7. Payments

  • All invoices are payable within the agreed payment period.
  • Goods may be withheld until all outstanding charges are settled.
  • Late payments may attract interest 12% of invoice value as penalty fee and administrative charge of $120 per invoice .
  • The Customer shall be responsible for any collection costs incurred in recovering overdue payments.

8. Liability

  • The Company shall not be liable for indirect, consequential, or special damages, including loss of profit or business interruption.
  • The Company’s liability for loss, damage, or delay shall be limited to the extent permitted by applicable law.
  • Claims for loss or damage must be submitted in writing within seven (7) days of delivery.

9. Insurance

  • Cargo insurance is not included unless specifically requested and paid for by the Customer.
  • Customers are encouraged to insure their goods against loss, damage, theft, or other risks during transit.

10. Claims for Loss, Damage, or Shortage

  • All claims for loss, damage, shortage, or misdelivery of cargo must be submitted in writing to Affluent Services Cargo within 7 days of delivery or collection of the goods.
  • Customers must inspect all cargo upon receipt and immediately report any visible damage, shortage, or discrepancies before signing delivery documents.
  • Claims must be accompanied by supporting documentation, including:
    • Commercial Invoice
    • Packing List
    • Proof of Delivery
    • Photographs of damaged goods (where applicable)
    • Any other relevant supporting evidence
  • Affluent Services Cargo shall not be liable for:
    • Loss or damage resulting from inadequate packaging by the customer or supplier.
    • Inherent defects, deterioration, or perishable goods.
    • Delays caused by customs inspections, border authorities, weather conditions, carrier schedules, strikes, or other circumstances beyond the Company’s control.
    • Consequential or indirect losses, including loss of profits, business interruption, or loss of market value.
  • Cargo insurance is not included unless specifically requested and paid for by the customer. Customers are strongly advised to insure high-value shipments.
  • The Company’s liability, where applicable, shall be limited to the actual proven value of the goods and shall not exceed the amount recoverable from the carrier, insurer, or other third party involved in the transportation process.
  • No claim shall be considered if all freight charges, customs duties, taxes, storage fees, or other outstanding amounts remain unpaid.
  • Claims submitted after the prescribed period may be rejected without further consideration.
  • Acceptance of a claim does not constitute an admission of liability by Affluent Services Cargo.
  • All claims shall be governed by the laws of the Republic of Zimbabwe and subject to the jurisdiction of Zimbabwean courts.

11. Force Majeure

The Company shall not be liable for failure or delay in performance resulting from events beyond its reasonable control, including natural disasters, war, civil unrest, pandemics, government actions, strikes, or transportation disruptions.

12. Storage and Warehousing

  • Storage charges may apply where cargo is not collected within the agreed period.
  • The Company reserves the right to dispose of unclaimed cargo in accordance with applicable laws after reasonable notice has been given.

13. Confidentiality

The Company shall treat Customer information as confidential and shall not disclose it except where required by law or necessary to perform the contracted services.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Zimbabwe.

15. Amendments

Affluent Services Cargo reserves the right to amend these Terms and Conditions at any time. Updated versions shall become effective upon publication or notification to customers.
